The game doesn't seem to be linked to any 3rd party IP (which is a roadblock that prevents the release of many other games), but the publishing rights currently seem to be with Take-Two, who has been very reluctant to sell anything DRM-free.

You could email the publishers and ask, of course. :)
Addendum: Apparently the game _is_ linked to Tom Clancy's books, but I'm not sure if that's a problem, we do have Clancy-related stuff on GOG already.

No, 3rd party intellectual property.

For example, old Star Trek games are hard to release, because doing so would not only require a contract with the current rights holder of the games, but also a contract with the current rights holder of the Star Trek franchise.

He meant whether the game is based on someone else's intellectual property (you know, like video games based on movies, comics or pen & paper RPGs). This is causing problems occasionally as GOG may not only need to get the rights to the game itself but also renew the deal with the owner of the franchise.

And Shadow Watch is indeed based on one of Tom Clancy's works but it was developed by Red Storm Entertainment and two games developed by Red Storm which are also based on Tom Clancy novels are already on GOG, so maybe there's a chance for a re-release on GOG.

Don't know, it was a couple of years ago. You can always look up on torrents, maybe you'll get lucky.

Yeah, I just did a quick search on a particular "bay" and found it. Only 5 seeders but you should try it.
