The current D&D licence is held by Atari until 2015. I don't think Ubisoft would be able to re-release any D&D properties until Atari's licence expires.

However, there is the issue of Hasbro's legal action against Atari which complicates things further.
And that's assuming Atari don't renew and the licence does expire.

Once a licenced title is split between so many parties, it's exceptionally difficult to get a game re-released because with so many parties wanting to turn a profit from the deal, it can quickly overpower the ability of niche titles to actually generate it.

SSI's last game was Pool of Radiance 2 and they released it in 2001 under the brand of Ubisoft. At that time it was either Interplay or Infogrames (Atari) that hold the D&D lisence, I don't know. Also, Neverwinter Nights was released (June 2002) under Atari, but Icewind Dale 2 was released (September 2002) under Interplay. So, the issue is a bit complicated and different than who hold the D&D license right now I think.

Because of the legal action between Hasbro and Atari, any renewal is currently very unlikely.
Damnit, i thought they pulled their collective heads out of their asses, thanks for the update but it's only a fan project. Fan projects are neat but they never seem to get completed.

One of the devs for the game already made a thread on the Might & Magic board on here about the project, that's how I originally found out about it.

The information I've found out from them (and from their facebook page) indicates for at least several years there were talks of developing the game and getting started and stuff, but all the ideas were eventually scrapped for development and the story. Eventually they took up the project again and started the story from scratch but this time as a fan project that has no official affiliation with Ubisoft.
