But there's a rack of swords easily accessible in the yard, and nobody reacts if you help yourself to 'em. You can even meet Loredo w/ a very noticeable two-handed sword on your back, and later walk out with it.

(2) If you follow King Ziggy back immediately after doing the stealth run, you'll quite possibly walk past still-KO'd guards. Ziggy doesn't blink an eye and the place isn't on alert. :D

You can pick up a sword, yes... but you can't use it at that point. Later on you can.

Just like you can help yourself to a generous amount of a families' orens. ^ ^ These things happen unfortunately... It'd be more impressive if the game's NPC's were more aware of things like this.... instead of some shoe-obsessed elf with actual shoes inside her house who we're supposed to be impressed by.
it was like this. if you did something bad a cutscene would play where the guards will ask you for payment and let you go. if you refused, you died.

but the devs or possibly the testers thought this was a little too much for looting and other petty crimes so they left it out.

a good thing, too. mostly because if geralt is handling death squads sent to kill him for being an accused kingslayer, then he should be able to kill town guards with impunity. even more so if your geralt is specced into arrow deflection. a scripted death like that is completely unbelievable.

You can still see this if you leave your sword drawn in town.
