So how is this going to be handled? Are you going to be punished just for VISITING a torrent site? For downloading a torrent? For being caught running one (which would be ridiculous...many legitimate businesses give torrent options)?

Also, since I didn't read the article, are AT&T or Time Warner/Roadrunner one of the participating ISPs?

For the record you don't get a strike just for downloading a torrent, you get a strike for downloading copyrighted material.

Shouldn't that be you get a strike for being suspected of downloading copyrighted material?

If they give 5 strikes for downloads that may not even be copyright material, that's ok? Unless they prove it I'd imagine you wouldn't get a strike?

If this is mainly aimed at torrents, then the way they get you is having a copyright bot crawl for torrents, connect to the swarm, then get a list of IP addresses with time stamps on them. Doing things like direct download and newsgroups won't be tracked unless ISPs are setting up some kind of deep packet inspection, which I'd imagine will raise all kinds of privacy issues and lawsuits. My little cable company isn't included, nor is my phone company as they are fairly big, but not on the level of Verizon or ATT.

You're the one who made it seem like it might be a valid excuse or something which would imply that there'd be no certainty of it being copyrighted material till it's repeated. It's either a proven fact or it's not in which case it's not an excuse either way.

If you say something's going to 'wash' for the first strike, that's where you implied there would be some sort of validity to the excuse, else it wouldn't.

Sure I except there is a slim chance of error on a first strike like a screwed up IP address or something, as there are no consequences at this point anyway, it's probably no big deal. I think You would have to be very unlucky for your ISP to get 6 complaints from copyright owners by mistake though, but even then there is an appeal system(independent) where you could set the record straight.

What scenarios can you imagine where someone might be given 6 strikes wrongly?
